These Terms of Service (“Terms”) govern your use of the Hearth app and related services provided by Hearth Health Inc. (“Hearth,” “we,” “us”). By creating an account or using Hearth, you agree to these Terms.

1. The service

Hearth helps home-care agencies, caregivers, and families share visit updates, messages, and care information. Features may vary by subscription plan and role (family, caregiver, or agency).

2. Accounts

You must provide accurate information and keep your login credentials secure. You are responsible for activity under your account. Notify us immediately at hello@hearthmeet.com if you suspect unauthorized access.

3. Acceptable use

• Use Hearth only for lawful care-coordination purposes.
• Do not upload false, harassing, or infringing content.
• Do not attempt to access data belonging to other users without authorization.
• Do not reverse engineer, scrape, or disrupt the service.

4. Subscriptions and payments

Family plans and tips may be billed through Stripe or other payment partners. Fees, renewal terms, and cancellation are shown at purchase. Agencies may have separate commercial arrangements.

5. Content and AI summaries

Visit summaries are generated automatically from caregiver input and may contain errors. They are informational only and are not medical diagnoses or treatment plans. Always consult qualified health professionals for medical decisions.

6. Intellectual property

Hearth’s software, branding, and design are owned by Hearth Health Inc. You retain rights to content you submit; you grant us a license to host, process, and display that content to provide the service.

7. Disclaimer

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEARTH HEALTH INC. SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

9. Termination

You may stop using Hearth at any time. We may suspend or terminate accounts that violate these Terms or pose security or legal risk.

10. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules, except where mandatory consumer protections apply in your jurisdiction.
